# Terms of service

## 1. Who provides Hermes Startup

Hermes Startup is provided by Diamond Hands Dig, trading as Hermes Startup ("Hermes Startup", "we", "us", or "our").

## 2. The service

Hermes Startup is a workflow that runs inside Hermes Agent, the user's own AI agent environment. It helps a user discover business ideas unique to them and choose one realistic path toward a first online dollar. The free path asks ten personal questions and returns all 10 of the user's potential ideas, each explained in detail and ranked with the reason why. The paid continuation builds and runs the chosen business — research, build, launch, and the team that keeps it running — funded through one prepaid balance, with every external action requiring the user's approval.

## 3. Payments

The paid continuation is a US$10 prepaid balance, paid once, in advance, through Stripe. It is not a subscription. The balance is debited per API call as tools are used and never expires. Optional user-controlled auto-top-up can replenish the balance when the user turns it on.

## 4. No guarantees

Hermes Startup does not guarantee income, customers, demand, or any business outcome. Business ideas and guidance are provided as information only. Any use of tools, providers, or external services is the user's responsibility and remains subject to that provider's own terms.

## 5. All sales are final

All sales are final where the law allows. Because the balance is prepaid and debited only when used, there is no voluntary refund of an unused or partially used balance except where required by applicable law or consumer protection legislation. Chargebacks and disputes are handled by Stripe under its own terms.

## 6. User conduct

The user is responsible for how they use Hermes Startup and any tool it invokes. The user must not misuse the service, attempt to access it through means other than Hermes Agent, or use it to break the law, infringe rights, or send unsolicited or misleading messages. Every external action — spending, posting, outreach, uploads, account changes — requires the user's explicit approval.

## 7. Intellectual property

The Hermes Startup workflow and its public source are open source under the MIT license (https://github.com/33hodl/hermes-startup). The Hermes Startup name and site content remain the property of Hermes Startup.

## 8. Privacy

Personal data is handled as described in the privacy notice (https://hermesstartup.com/privacy).

## 9. Changes

We may update these terms when our practices or legal requirements change. The current version is published here.
